1. Agreement to Terms
By accessing or using Flashtie ("the Service"), operated by Flashtie ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Flashtie is a web-based platform that allows wedding organizers to create dedicated event pages with QR codes. Wedding guests can scan these QR codes to upload photos, videos, and personal wishes without needing to download an app or create an account. The Service includes event management, media storage, QR code generation, a card designer, and related features.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Plans and Payments
Flashtie offers one-time purchase plans (Starter, Pro, Unlimited) with varying guest limits. All payments are processed securely through our third-party payment provider, Lemon Squeezy. Prices are listed in USD and are inclusive of the features described on our pricing page at the time of purchase.
Each plan grants access to the Service for 12 months from the date of purchase. After this period, the event becomes inactive and no new uploads are accepted. You may purchase a new plan to reactivate your event.
5. Refund Policy
Due to the digital nature of the Service, all purchases are final. We do not offer refunds once a plan has been purchased and activated. If you experience technical issues preventing you from using the Service, please contact us and we will work to resolve the issue.
6. User Content
You retain ownership of all content you upload to the Service, including photos, videos, audio recordings, and text messages ("User Content"). By uploading content, you grant Flashtie a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service.
You represent and warrant that you have the right to upload the content and that your content does not violate any third-party rights or applicable laws. You are solely responsible for the content you and your guests upload.
7. Guest Uploads
As an event organizer, you are responsible for informing your guests that their uploads will be stored on Flashtie and accessible to you and any co-organizers you have invited. Guests upload content voluntarily, and by scanning the QR code and uploading content, they agree to these terms.
8. Content Storage and Deletion
All uploaded content is stored for 12 months from the date of your plan purchase. After this period, content may be automatically deleted. We recommend downloading all content you wish to keep before your plan expires. We are not responsible for content that is not downloaded before the expiration period.
9. Prohibited Use
You agree not to use the Service to:
- Upload illegal, harmful, threatening, abusive, or otherwise objectionable content
- Upload content that infringes on intellectual property rights of others
- Upload malware, viruses, or other harmful code
- Attempt to gain unauthorized access to the Service or its infrastructure
- Use the Service for any purpose other than personal wedding event management
- Resell or redistribute the Service without our written consent
10. Co-Organizers
You may invite co-organizers to help manage your event. Co-organizers will have access to event settings, uploaded media, and guest wishes based on their assigned role (editor or viewer). You are responsible for ensuring that co-organizers comply with these terms.
11. Intellectual Property
The Service, including its design, features, code, and branding, is owned by Flashtie and protected by intellectual property laws. Card templates provided within the Service are licensed for your personal use in connection with your wedding event only.
12. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify users of planned downtime.
13. Limitation of Liability
To the maximum extent permitted by law, Flashtie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of content, or loss of profits, arising from your use of the Service. Our total liability shall not exceed the amount you paid for your plan.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times.
15. Account Termination
We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we determine to be harmful to the Service or other users. You may delete your account at any time through your account settings.
16. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
17. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Flashtie operates, without regard to conflict of law provisions.
